2) Agreement to terms

By using our website, contacting us, or purchasing any service, you agree to these Terms. If you do not agree, please do not use our services.

3) Our services

4) No guarantee of outcome

We are not a university and we do not guarantee admission, scholarships, visas, or specific outcomes. Final decisions rest with third-party institutions and authorities.

5) Eligibility

You must be 18+ (or have verifiable parental/guardian consent) and able to form a binding contract under UK law.

6) Your responsibilities

You agree to:

• Provide accurate, complete, and timely information/documents
  
• Meet deadlines, pay fees when due, and follow institution rules
  
• Inform us promptly of changes (e.g., grades, address, passport)
  
  

You are responsible for verifying institution requirements (entry criteria, English proficiency, fees, deadlines).

7) Fees, payment & refunds

• We will confirm fees before you commit. Quotes exclude third-party charges (e.g., university, test providers, visa fees) unless we state otherwise.
  
• Invoices are due as stated; late payment may pause services.
  
• Non-refundable items: application processing fees, any third-party fees already paid, and services already delivered.
  
• Consumer cooling-off: If you buy as a consumer online/phone/email, you may cancel within 14 days of acceptance under UK Consumer Contracts Regulations unless you asked us to start work before the 14 days; in that case, a reasonable amount for work done will be deducted, and digital/one-off services already completed are non-refundable.
  
• Course cancellations/refunds (if applicable) will be stated on each course page or joining email; if not stated, you may cancel up to 7 days before start for a refund minus a reasonable admin fee; within 7 days no refund (unless required by law).
  
  

8) Scheduling & rescheduling

We may reschedule sessions for reasons beyond our control (e.g., tutor illness). If we cancel a paid session and cannot reschedule within a reasonable time, you’ll receive a refund for that session.

9) Visa/immigration disclaimer

We do not provide immigration advice unless expressly stated and regulated for that service. Any general visa guidance is for information only; you must seek qualified, regulated advice where required.

10) Intellectual property

All site content, course materials, documents, and branding are owned by or licensed to Smart Mind. You may not copy, distribute, sell, or exploit any content without our written permission, except for personal, non-commercial use.

11) Acceptable use

Do not misuse the website or services (e.g., upload unlawful or infringing material, attempt security breaches, spam). We may suspend or terminate access for misuse.

12) Third-party links & services

Our site may link to third-party sites/services we do not control. We are not responsible for their content, terms, or policies.

13) Limitation of liability

We do not exclude liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
Otherwise, to the maximum extent permitted by law:

• We are not liable for indirect or consequential loss, loss of profit, or loss of opportunity.
  
• Our total liability for any claim relating to paid services is limited to the amount you paid for the specific service giving rise to the claim.
  
  

14) Events outside our control

We are not liable for delays or failure to perform due to events beyond our reasonable control (force majeure).

16) Governing law & jurisdiction

These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have exclusive jurisdiction, subject to consumer law rights.
